What happens when you sign an affidavit

An affidavit is a written statement you swear or affirm is true. In Nevada this is usually done with a jurat. You sign in front of Patricia, and she gives you an oath or affirmation. She then completes the notary wording and adds her seal.

The oath is real. You're promising the statement is true. Read the document closely before she arrives, and if anything in it is wrong, have it fixed first.

Some documents say "subscribed and sworn" near the signature line. That wording usually means a jurat. Others say "acknowledged before me," which is an acknowledgment. If you're not sure, ask the person or office that asked you for the document. They decide which one you need.

What Patricia can't do

Patricia doesn't draft documents or give legal advice. Your attorney or the document's issuer does that. She can't tell you what to write in an affidavit or which form you need.

Nevada notaries also can't certify copies of birth, death or marriage certificates or divorce decrees (NRS 240.075). Request certified copies of those from the office that issued them. If they're headed overseas, an apostille may be what you actually need.

What to have ready

  • A current government-issued photo ID for each signer
  • The completed affidavit, unsigned until Patricia is there
  • Every signer present and willing to swear or affirm
  • Witnesses, if the document calls for them
  • Any instructions from the court, agency or attorney asking for it
  • No ID? Ask about credible witnesses.

Questions people ask

What's the difference between a jurat and an acknowledgment?

With a jurat, you swear or affirm the document is true. With an acknowledgment, you confirm you signed it willingly. The form or the person who asked for it decides which one you need.

Can you make a certified copy of my birth certificate?

No. Nevada notaries can't certify copies of birth, death or marriage certificates or divorce decrees. Order a certified copy from the issuing office.

How much is a jurat?

Nevada law sets it at $15 per signature, plus any travel fee agreed in advance. See fees.

Can you notarize a travel consent letter for my child?

Yes. Fill in the letter completely, then sign it in front of Patricia with your photo ID. If both parents are signing, both need ID.
